Founded in 1996 PBS Ltd is now a leading UK company specialising in the collection of commercial rent arrears. We act on behalf of commercial landlords throughout England and Wales.

From 6th April 2014 new regulations are in force governing the enforcement industry as a whole. The new regime is known as Commercial Rent Arrears Recovery or CRAR, and replaces the old Laws of Distress.

Client's instructions will still be handled swiftly and arrears collected with the utmost urgency. The new system is more modern and will operate in a calmer more efficient manner, being fairer to all concerned.

There are two main differences between the old and new systems.

The first and biggest difference is the Enforcement Notice, a notice which enforcement agents must send to the tenant giving them 7 working days to pay their arrears. (Sundays and Bank Holidays don't count as working days).

These notices can be sent by post or they can be emailed, ensuring the speediest action possible. We cannot visit the tenant to enforce for the arrears until this 7 day period expires.

The other big difference is that under CRAR we cannot enforce for Service Charges and Insurance arrears. Even if you have an all inclusive lease, these charges must be calculated and excluded under CRAR.

But there is no need for clients to despair - we can still collect these charges as an ordinary debt. We are offering free debt collection for service charges and insurance, if you instruct us to collect the debt at the same time you instruct for the rent. The two processes will run simultaneously, and if we collect the debt at the same time as the rent we will not charge you or your tenant for the debt collection. The standard legal charges as dictated by CRAR will still apply for the rent.

Please remember that these are separate instructions. and we cannot enforce for the debt. If we are unable to collect the debt in this manner, it will need to go into the usual debt collection system, where we charge an initial £25 and take a fee of 10% of any monies collected. Both charges are subject to VAT at 20%.
